RE:
A request for advisory opinion, submitted by Christian M. Miltenberger, inquiring as to whether the Louisiana Code of Governmental Ethics provides any additional post-employment restrictions related to other institutions in the LSU System.
Facts:
Christian M. Miltenberger was employed at LSU Health Sciences Center in New Orleans ("LSUHSC") until January 10, 2020. He subsequently accepted employment with Varonis Systems as a Sales Engineer for Louisiana. Varonis Systems is a software vendor of which LSUHSC is a customer. During the hiring process, he informed Varonis Systems of the post-employment restrictions set forth in La. R.S. 42:1121(B). As a result, Varonis Systems assigned another Sales Engineer to the LSUHSC account.
While he does not handle the account for LSUHSC, another institution in the LSU System is a prospective client. As a result, he is requesting an advisory opinion as to whether he would be prohibited from working on the account for another LSU system institution.
Law:
La. R.S. 42:1121(B) provides no former public employee shall, for a period of two years following the termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following the termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties
Recommendations:
Adopt the proposed recommendation.
