Advisory opinion regarding whether the Richardson Medical Center/Richland Parish Hospital Service District No. 1B may enter into a lease for a medical office building owned by an employee.
Facts:
Dr. Kyle Bruyninckx is employed with Richardson Medical Center (RMC). RMC is a political subdivision of the state set up by the Richland Parish Police Jury. Dr. Bruyninckx wants to acquire property to build a medical office building. RMC wants to lease the space from Dr. Bruyninckx in a written agreement with fair market value rent to be determined by appraisal.
Law:
La. R.S. 42:1113(A)(1)(a) states that no public servant, or a member of such a public servant's immediate family, or a legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract or other transaction that is under the supervision or jurisdiction of the agency of such public servant.

La. R. S. 42:1113(D)(1)(c)(ii) states than an agreement with a state entity or state quasi-public entity for housing, medical treatment, retirement benefits, or insurance benefits provided on the same terms and conditions available to similarly situated persons shall not be considered a contract for purposes of this Subsection.
