Advisory opinion regarding whether the Code of Governmental Ethics would prohibit former Coastal Resources Scientist Senior for the Coastal Protection and Restoration Authority of Louisiana (CPRA) from assisting CE Hydro, LLC in any transaction in which she participated during her public service employment for a period of two years, following her termination of employment with CPRA.
Facts:
Jennifer Mouton began her employment with the Louisiana Department of Environmental Quality in 1991 as an Environmental Specialist. She stated that in 2009, she began working for the Coastal Protection and Restoration Authority of Louisiana (CPRA) as a Coastal Resources Scientist Senior- DCL-B in the River Studies Section of the Planning and Research Division. She stated that she did not exercise any supervision over any CPRA employees and she was not an agency head. She also stated that her duties as a Coastal Resources Scientist Senior included project manager for the Southwest Coastal Louisiana Feasibility Study, study manager for the Lowermost Mississippi River Management Study Program, CRPA team member for various Calcasieu River dredging projects and participation as a project delivery team member providing technical support for the Calcasieu Salinity Control Project Study team. She stated that she retired in January 2019 and began working for CE Hydro, LLC, a company that provides water resource to engineering solutions for flood risk management and coastal management services to various clients, as a Senior Scientist/ Project Manager in August 2019.
Law:
La R.S. 42:1121B(1): No former public employee shall, for a period of two years following the termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
