Facts:
Joseph Piconne, III, a member of the Law Enforcement Officers and Fireman's Survivor Benefits Review Board, received a NOD requesting he file a 2018 Tier 2.1 PFD. Mr. Piconne does not believe the Law Enforcement Officers and Fireman's Survivor Benefits Review Board has the authority to expend, disburse or invest $10,000 or more in funds in a fiscal year.

The Review Board was created pursuant to statute, La. R.S. 40:1665.3, under the Department of Justice. The purpose of the Review Board is to determine whether the injury or death of a law enforcement officer or fireman is entitled to benefits from the fund. La. RS.. 40:1665.3 provides that the Review Board shall hear and decide by unanimous vote all claims for survivor benefits within sixty days after documentation is received. La. R.S. 39:1533 provides that payments for law enforcement officers and firemen survivor and disability benefits as provided for in R.S. 40:1665(C), 1665.2(C), and 1668 shall be made by the office of risk management on behalf of the Law Enforcement Officers and Firemen's Survivor Benefit Review Board as a result of a specific appropriation received for that purpose.


Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
Recommendations:
Advise members of the Review Board they are required to file annual Tier 2.1 PFDs.
