RE:
Request that the Board waive a $2,000, $600 and $2,000 campaign finance late fee assessed against Marteze DeSean Singleton, a candidate for State Representative, 20th Representative District, Caldwell, Catahoula, Frankin, LaSalle and Tensas Parishes in the October 12, 2019, whose 30-P, 10-P & 10-G campaign finance disclosure reports were filed 115, 12 & 60 days late, respectively.
Facts:
Mr. Marteze Singleton request a waiver and states the following:


This is his first election. He did the campaign by himself and wasn't aware of all the filings that needed to be done. However, after receiving the notices, he took the correct actions to file the documents. On January 13, 2020, he did call the office to get more information on filing the waiver, but the office was closed due to a holiday. He spoke with a staff member on 1/14/2020 and is the reason for waiver being untimely. Going forward, he will take the necessary steps in getting report filed as required by the State. He is not financially able to pay the outstanding fees.

Mr. Singleton provided financial information that shows annual income of under $30,000 per year and monthly expenses of approximately $3,000.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

18:1495.4D(1) If the final report of a candidate for an election, as required by Paragraph (5), (6), or (7)of Subsection B of this Section, shows a deficit or a surplus, the candidate and his treasurer, if any, shall file supplemental reports with the supervisory committee of all information required in R.S. 18:1495.5. Such reports shall be filed annually no later than February fifteenth and shall be complete through the preceding December thirty-first. Such a supplemental report shall be filed each year until a report has been filed which shows no deficit and until any surplus campaign funds have been disposed of in accordance with R.S. 18:1505.2(I). The report on surplus funds shall disclose the disbursement of such funds in the same manner as expenditures are reported.

Recommendations:
Reduce fines for 30-P and 10-G to $600 based on 1205(B), and suspend all based on future compliance.
