RE:
Advisory opinion regarding whether Ernest Bourdreaux, an employee of the Town of Lockport, may continue to be employed part-time by the town if he is elected to the Lockport Town Council.
Facts:
Mr. Boudreaux stated that he has been employed by the town of Lockhart as a part-time employee in the Maintenance Department for the past year and a half. He stated that the maintenance department employs four people. He also stated that his immediate supervisor is Michael St. Pierre. He stated that the Mayor, Ed Rienhart, signs his check and has the authority to hire and fire. He stated that his job duties include working with drainage and sewage and operating machinery. He also stated that he is running for Lockport Town Council. He stated that the Lockport Town Council does vote and approve items related to the budget of his agency.
Law:
La. R.S. 42:1113A states no public servant, or a member of such a public servant's immediate family, or a legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract or other transaction that is under the supervision or jurisdiction of the agency of such public servant.

La. R.S. 42:1112A prohibits a public servant from participating in a transaction involving his governmental entity in which he has a substantial economic interest.
La. R.S. 42:1120.4 provides an exception for elected officials to recuse themselves from voting on matters that violate section 1112 of the Code.
