Waiver request submitted by Jerry Wayne Beatty, Concordia Parish Police Jury / District 4, Place A, regarding a $1500.00 late fee assessed for filing his amended 2018 Tier 3 annual pfd 66 days late.
Facts:
Jerry Beatty is requesting a waiver for the late filing of his 2018 PFD Amendment. Mr. Beatty stated in the 12 years he has served as a Concordia Police Jury, he has never missed a filing. Mr. Beatty stated that 15 months ago he lost everything (his family and car). He now rides a bicycle to work and could no longer attend the board meeting or participate in political activities within his community. This led to him losing his seat and he has never been able to recover. Mr. Beatty stated he does not know how he missed filing his 2018 Annual PFD; and he does not recall receiving the NOD-FF letter, although he signed the Certified Mail Green Card. Mr. Beatty stated he has been through so much in the past 15 months with losing everything; he is simply trying to survive at this point. Mr. Beatty is asking the Ethics Board to waive the fine because he does not have any funds (or transportation) to pay the late fee penalty.

Law:
La. R.S. 42:1124.3 requires persons holding a public office who represent a voting district having a population of less than 5,000 and each member of the governing authority or management board of a charter school created pursuant to Chapter 42 of Title 17 of the Louisiana Revised Statutes of 1950 to file a financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
