Waiver request submitted by Judith "Judy" Goodwyne-Miranti, Board of Elementary and Secondary Education, regarding a $2500.00 late fee assessed for filing her 2015 Tier 2 annual pfd 1250 days late.
Facts:
Mrs. Judy Miranti is requesting a Waiver Request for the late filing of her final Tier 2 PFD Statement. Dr. Miranti stated she inadvertently filed a Tier 2.1 Report instead of a Tier 2. She stated she served on the Board of Elementary and Secondary Education until January 2016. When she was not reappointed, she thought she did not have to file for 2016. Once notified that she needed to submit a Tier 2 for 2016, she filed Tier 2.1 PFD instead. On January 2, 2020, while returning from visiting Naples, Fla for Christmas, she received a Ring Alert. After watching the Ring Alert playback video, she learned it was a state trooper attempting to deliver a packet. She called Troop B and was informed she could pick up the packet from the failed attempt. The packet was the BOE several attempts to notify her of the late fee.

Dr. Miranti stated she never intended not to file the disclosure statement. She respectfully requests the Ethics Board to consider her waiver request and would appreciate appearing before the Board to discuss my case. She stated she will do whatever is needed in order to be in compliant.

In a phone conversation on 2/10/2020, Mrs. Miranti stated she never received the 2015 NOD-FF which was mailed to the Xavier University address. The NOD-FF Green Card was signed by a Tiffany Washingston. Mrs. Miranti said she does not know a person by that name, but it could have been a University Staff Member or Student Worker.

Law:
La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Waive the late fee.
