RE:
Request for review and approval of a Disqualification Plan, submitted by Warden Pat Johnson of the Ouachita Parish Correctional Center ("OPCC"), concerning the promotion of one twin sister to a supervisory rank within the medical unit.
Facts:
In order to address inmate and staff health concerns, the OPCC employs a staff of eight (8) LPN deputies. Brandi Greer and Britany Glynn are twin sisters who were hired as two (2) of the eight (8) LPN deputies on January 20, 2016 and January 21, 2016, respectively. The eight (8) LPN deputies are supervised by two (2) LPN sergeants. Based on her performance and a recommendation from the Lieutenant Registered Nurse, who supervises the eight (8) LPN deputies and two (2) LPN sergeants, Brandi Greer is being considered for a promotion to one of the vacant LPN sergeant positions.
Should Brandi Greer be promoted, she would work a static shift, that is necessary for duties of that rank, while her sister - Britany Glynn, would continue working the swing shift.

While most of the LPN sergeant's tasks are related to the care of inmates and assistance of physicians, three (3) of the tasks are specifically related to matters involving subordinates (addressing discipline and other personnel matters, scheduling time off for staff, and reviewing/addressing Administrative Remedy Procedure submissions).

In order to prevent any violation of La. R.S. 42:1112(B)(1), Warden Johnson has proposed a disqualification plan where Brandi Greer would not handle any ARP submissions (complaints) concerning Brittany Glynn or any personnel matters concerning Britany Glynn. Should those matters arise, they will be forwarded to the Lieutenant RN for review and handling. Should any potential violations of departmental policies arise with regard to Brittany Glynn, the matter will be investigated by the Lieutenant RN or the on-compound detective. Additionally, Brandi Greer will not have any oversight of Brittany Glynn's requests for time off. Lastly, the Lieutenant RN will personally dictate the daily responsibilities of Brittany Glynn, as opposed to Brandi Greer (the LPN Sergeant).

Law:
La. R.S. 42:1112(B)(1) states that no public servant shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any member of his immediate family has a substantial economic interest.
La. R.S. 42:1112(C) allows a disqualification plan to be developed in accordance with rules adopted by the Board to remove a public servant from participating in transactions that would otherwise present violations of Section 1112 of the Code.
Recommendations:
Approve the proposed Disqualification Plan.
