Waiver request submitted by Candace Perry, Thrive Academy Charter School Board/East Baton Rouge, regarding a $1500 late fee assessed for filing her amended 2017 Tier 2.1 Annual PFD 177 days late.
Facts:
Candace Perry is seeking a waiver for the late filing of her Amended 2017 Annual PFD and stated the following. Ms. Perry stated that the mail issued to her regarding her delinquencies was being mailed to her former home address; where her ex-husband currently resides. Due to this, Ms. Perry received her mail from her ex-husband late. She is requesting the waiver for this reason and due to her financial status. Ms. Perry stated she is a public school teacher and now a single mother that cannot afford the $1500 fine. She said she is still dealing with the backlash of filing for divorce and tax issues resulting from their divorce. Ms. Perry stated she is physically doing everything she can for her daughters, and doing what is necessary to better herself. Her "prayer" is that the Ethics Board waive her late fine so that she does not have one more financial matter "looming" over her due to her current marital status.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the reporting requirements under the Code of Ethics.
