A request for an advisory opinion, submitted by the Town of Jonesboro Attorney, regarding whether the Louisiana Code of Governmental Ethics ("Code") would prohibit the Mayor of Jonesboro from appointing an employee in the Office of the Mayor to the board of commissioners for the Jonesboro Housing Authority.
Facts:
The Town of Jonesboro is governed by the Lawrason Act (La. R.S. 33:321, et seq.). The Town of Jonesboro has adopted a mayor-board of aldermen form of government. The Jonesboro Housing Authority was created by the Town of Jonesboro as a political subdivision of the state, pursuant to the provisions of La. R.S. 40:381 et seq. The area of operation of the Jonesboro Housing Authority includes the Town of Jonesboro and the area within ten miles from its territorial boundary. The Jonesboro Housing Authority is governed by a Board of Commissioners composed of five members who are appointed by the Mayor of the Town of Jonesboro. Members of the Board of Commissioners of the Jonesboro Housing Authority must be residents of the area of operation. The Mayor of Jonesboro would like to appoint an employee of the Town of Jonesboro as a Jonesboro Housing Authority commissioner.
Law:
La. R.S. 42:1113(A)(1)(a) states no public servant, excluding any legislator and any appointed member of any board of commission and any member of a governing authority of a parish with a population of ten thousand or less, or member of such a public servant's immediate family, or legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
Recommendations:
Adopt the proposed advisory opinion.
