Waiver request submitted by Richard J. "Richie" Lewis, St. Bernard Parish Council At-Large (West), regarding a $2500 late fee assessed for filing his amended 2017 Tier 2 Annual PFD 429 days late.
Facts:
Shawn Rogues, of Whiteside & Simms CPA, LLC is requesting a waiver on behalf of Richard Lewis for the late filing of his 2017 PFD Amendment.

Mr. Rogues stated he spoke to Mr. Lewis and Mr. Lewis provided the following cause for the late filing of his amendment: The Councilman At-Large filed his original Annual Personal Financial Disclosure Statement for 2017 and was unaware of the omission of the Schedule F. In February 2020, Mr. Lewis called the Louisiana Board of Ethics regarding an unrelated issue and was informed during the phone conversation that there was an error with his 2017 PFD filing. He was then instructed how to correct the Schedule F form and where to send it. Mr. Lewis did not willfully neglect to file his amendment, and took immediate actions to remedy the situation once notified of the omission. Mr. Rogues stated Mr. Lewis takes his position seriously, and has always filed required reports in a timely manner.

Law:
La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
