RE:
Waiver request submitted by Patricia Ann Pourciau, Workforce Development Board, First Planning District Area #10, regarding a $1500 late fee assessed for filing her amended 2017 Tier 2.1 Annual PFD 140 days late.
Facts:
Patricia Pourciau is requesting a waiver for the late filing of her 2017 PFD Amendment. Ms. Pourciau stated she began serving on the First Planning District Workforce Development Board in a volunteer capacity and resigned from the board when she retired from her position as a public school administrator in June of 2018.

Regarding her fee assessment, she stated she responded to the BOE within the 7 business days of a receiving her NOD to Amend her Schedule E form and submitted her amended report. She also provided a timeline and stated that her timeline (submitted with supporting documents) displays "how arbitrary, capricious, and ridiculous "that she "MUST reply within 7 days, or 10 days, or 20 days depending on the department and the BOE can take up to 390 days to send the FIRST notice of an omission from an April 28, 2018 filing".


* Ms. Pourciau was requested to amend both the 2017 and 2018 reports. She only filed the 2018 report timely.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the reporting requirements under the Code of Ethics.
