Advisory Opinion request of Daffaney J. Webster, a registered nurse with LDH, regarding her non-profit organization, Reflection of the Green Leaf Project, receiving a grant from the East Baton Rouge Consolidated Government.
Facts:
Daffaney Webster is currently employed as a registered nurse in the Eastern Louisiana Mental Health System within the Louisiana Department of Health, Office of Behavioral Health. She works at the Forensic Aftercare Clinic in the Community Forensic Services Division located in New Orleans. Her duties include treating post-discharge forensic patients of Louisiana's state psychiatric hospitals.

Ms. Webster started Reflection of the Green Leaf Project, a 501(c)(3) non-profit organization, whose mission is to develop resources and enrichment opportunities for those that suffer from a mental illness by decreasing barriers through the promotion of enrichment programs, bridging gaps of communication, cultivating relationships, and integration into society. The East Baton Rouge Parish Consolidated Government has partnered with the Arts Council of Greater Baton Rouge to fund a grant to support arts and cultural programming in East Baton Rouge Parish. Reflection of the Green Leaf Project has submitted an application to provide polymer clay art classes to incarcerated adult females in the East Baton Rouge Parish Prison to assist them with the development of creative trades for entrepreneurship for life post-release.

Law:
La. R.S. 42:1113A provides that no public servant, or legal entity in which she has a controlling interest, shall bid on or enter into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.

Docket No. 2019-647 (attached): The Board determined that Reflection of the Green Leaf Project would not be prohibited from receiving grant funding from the East Baton Rouge Parish Drug Court since the grant was not with Ms. Webster's agency, the Community Forensic Services Division.


Recommendations:
Adopt the proposed advisory opinion.
