Waiver request submitted by Perry Corrice Catchings, Hammond Area Economic and Industrial Development Board, regarding a $250 late fee assessed for filing his amended 2017 Tier 2.1 Annual PFD 5 days late.
Facts:
Perry Catchings is seeking a waiver for the following reasons:

Mr. Catchings stated he filed a 2017 Tier 1 PFD on May 15, 2018. However, he initially filed the incorrect Tier, as he is a Tier 2.1 filer. He was contacted in August 2019 and instructed to amend the 2017 Disclosure by completing a 2017 Tier 2.1 Disclosure. He then submitted his amended PFD on a Tier 2 Disclosure, not a Tier 2.1 Disclosure as instructed, but checked the box stating that "I currently hold an office that would require me to file a Tier 2.1 or Tier 3 Personal Financial Disclosure".

Mr. Catching stated he mistakenly submitted the incorrect documents, and he had every intent on adhering to the filing regulations and time frames. He understands that he was responsible for the filing. However, he expressed that his multiple attempts to correct his mistake proves he tried to comply with the Ethics filing requirement and regulation. On August 19, 2019, Mr. Catching submitted a compliant Tier 2.1 PFD statement and has filed all other disclosure correctly since then. He asks and thanks the Ethics Board for considering waiving his $250 PFD late fee.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the Code of Ethics.
