RE:
Consent opinion regarding, former St. Tammany District Attorney, Walter Reed's violation of Sections 1111A and 1111C(1)(a) of the Code of Governmental Ethics by providing prohibited legal services to the St. Tammany Hospital District.
Facts:
This opinion memorializes that Walter Reed violation of Sections 1111A and 1111C(1)(a) of the Code of Governmental Ethics and his restitution of $82,500 made to the St. Tammany Parish Hospital District No. 1.


Law:
La. R.S. 42:1111A prohibits a public employee from receiving anything of economic value, other than compensation and benefits from the governmental entity to which he is duly entitled, for the performance of the duties and responsibilities of his office or position.

La. R.S. 42:1111C(1)(a) prohibits a public servant from receiving any thing of economic value for any service, the subject matter of which is devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and in which the public servant has participated.

La. R.S. 16:2A states that the district attorneys shall ex-officio be the regular attorneys and counsel for the police juries, parish school boards, and city school boards within their respective districts and of every state board or commission domiciled therein, including levee boards, hospital and asylum boards, education boards, and all state boards or commissions the members of which, in whole or in part, are elected by the people or appointed by the governor or other prescribed authority.

Recommendations:
Adopt and publish the consent opinion and dismiss the charges with the EAB.
