Review of proposed changes to the campaign finance disclosure reporting forms based on legislation enacted during the 2020 Regular Legislative Session.
Facts:
Act 161 of the Regular Legislative Session provides for the aggregate reporting of the sale of raffle tickets that are sold for less than $25 each. This statute goes into effect January 1, 2020, with the first reporting in such a manner on reports filed after February 18, 2021.

Currently and prior to the effective date of Act 161, each person who purchases a raffle ticket is identified as a contributor to the campaign.



To accommodate the change in the reporting requirements dictated by the provisions of Act 161, the staff also made changes to the summary pages of campaign finance disclosure reports. The proposed changes are highlighted on the attached forms.

Furthermore, Act 161 deletes the requirement that contributors making cash contributions must provide their social security number on the receipt for cash contributions. This change has been deleted from the instructions and the summaries.




Law:
18:1511.3A(2) provides for the procedure for approval of campaign finance disclosure reports as follows:



All forms required by the Campaign Finance Disclosure Act and all instructions and explanation for the completion of such forms prepared by the supervisory committee shall be submitted to the Senate Committee on Senate and Governmental Affairs and the House Committee on House and Governmental Affairs for review and approval. The approval of each legislative committee shall be required prior to the utilization of a form or related instructions or explanation. The committees are required to meet, either separately or jointly, within sixty days of receipt of the documents to consider and act on the proposed form, instructions, or explanation. Approval requires a favorable vote of a majority of the members present and voting, a quorum of the legislative committee being present. If the proposed form, instructions, or explanation fails to receive the approval of both legislative committees within sixty days after submission by the supervisory committee, the proposed form, instructions, or explanation shall be withdrawn from consideration.

Recommendations:
Approve the changes to the forms and instructions for submission to the oversight committee for review and approval.
