Waiver request submitted by Lee Condolle, City of Patterson Council/St. Mary Parish (Pop. 6112), regarding a $2500 late fee assessed for filing his 2018 Tier 2 annual PFD 289 days late.
Facts:
Lee Condolle is seeking a waiver for failing to file his 2018 PFD Statement for the following reasons:

Mr. Condolle stated the late fee would create a financial hardship as he cannot afford to pay his $2500 late fee assessment. He has had to file for bankruptcy.

Mr. Condolle stated that he filed his 2018 PFD by regular mail after he received the initial Notice of Delinquency. Unfortunately, he did not pay to have it tracked and the BOE never received it. He said he really would like to continue serving his community and would not want his late filing fee to affect him in the next election. Mr. Condolle stated he will never file late again. He asks the Ethics Board to please consider this request. He thanks the Ethics Board in advance for their consideration. Mr. Condolle included three pay stubs as his supporting documentation: a pay stub for the St. Mary's Schoolboard (received monthly), one he receives as a St. Mary's Parish Councilman and one from KBZE Radio Station (both received bi-weekly).

Law:
La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the reporting requirements under the Code of Ethics.
