RE:
Waiver request submitted by Donald A. Callais, former member of the Veterans Memorial District, Lafourche Parish, Ward 10, regarding a $1500 late fee assessed for filing his 2018 Tier 2.1 annual PFD 250 days late.
Facts:
Donald Callais is requesting a waiver for failing to file his final PFD Statement covering calendar year 2018 for the following reasons:

Mr. Callais stated during the time when it was due, he simply overlooked the need to complete the disclosure. He apologizes to the Ethics Board as this is not an excuse. He stated the delinquency notice was received and signed by his wife during the time when their daughter and her children were living with them, so their home was a bit chaotic, and he never received the letter.

Mr. Callais stated that the Veterans Memorial District makes a true effort informing the board members to file timely. However, during that time he was serving as an interim board member and the person he was filling in for had returned, so he was not present during the filing reminder. He asks the Board to please waive his late fee as all of his other disclosures have been timely filed and compliant.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the reporting requirements under the Code of Ethics.
