Waiver request submitted by James "Jim" F. Brown, Jr., Denham Springs Development District Corporation, regarding a $1500 late fee assessed for filing his 2018 Tier 2.1 annual PFD 244 days late.
Facts:
Mr. Brown is submitting a waiver request for the late filing of his 2018 PFD Statement for the following reasons:

Mr. Brown apologizes for not filing his statement on time. He stated the Notice of Delinquency was signed on December 26, 2019. With the bustle of the holiday season, the letter was apparently misplaced. Mr. Brown would deeply appreciate the Ethics Boards' consideration to waive his late fee of $1500.

Lyn Tedder, daughter of James F. Brown, is writing a waiver on behalf of her father. Ms. Tedder stated her father is 81 years old and over the past year and a half, has been increasingly showing signs of Dementia, with periods of confusion and forgetfulness. Ms. Tedder has submitted a letter from Mr. Brown's neurologist, Dr. Jon D. Olson. She hopes that the Ethics Board would consider waiving the late fee her father was assessed, as she feels it would create a financial hardship for her parents, as their attention and finances need to be directed towards Mr. Brown's health and medical/pharmacy bills. Dr. Jon D. Olson submitted a letter stating Mr. Brown is currently under his care for memory and other medical concerns. Dr. Olson recommended Mr. Brown be made into an Emeritus board member, so that Mr. Brown could still attend meetings and contribute, but not have any voting authority.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Suspend all based on future compliance with the reporting requirements under the Code of Ethics.
