Waiver request submitted by Lisa Hahn Coker, former member of the State Board of Massage Therapy, regarding a $300 late fee assessed for filing her 2018 Tier 2.1 annual PFD 6 days late.
Facts:
Lisa Hahn Coker is requesting a waiver for the late fee assessed for the late filing of her final PFD for the following reasons:

Ms. Coker stated she resigned from the State Board of Massage Therapy on February 8, 2018 due to her fathers' illness with cancer. Ms. Coker stated that since she resigned from the board so early on in 2018, she was not aware that she was required to file the Annual Disclosure covering calendar year 2018.

For the majority of 2019, she was out of work as a therapist with Bumble Lane Spa due to a physical injury. She did not return to work until November 2019 and her work hours prevented her from being able to make it to the post office in time. As Ms. Coker is a single mother, she had her mother pick up any registered mail. Ms. Coker did not receive the letter until after its due date. When she noticed it was past its due date, she tried her best to submit the financial statement, but due to her work schedule and child custody schedule, her disclosure was six days late. Due to the Covid-19 Pandemic, she is currently out of work and has a limited income. Ms. Coker apologizes for the inconvenience and respectfully asks the Ethics Board to waive, reduce, or suspend her late fee. She would appreciate any consideration regarding this matter.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the reporting requirements under the Code of Ethics.
