Reconsideration of a request that the Board waive the $2,000 late fee assessed against Denise Holden, a candidate for Orleans Parish Council, in the February 6, 2010 election, whose Supplemental campaign finance disclosure report was filed 35 days late.
Facts:
In connection with her request for reconsideration of a waiver of the $2,000 late fee assessed for the late filing of her Supplemental campaign finance disclosure report, Denise Holden, states that she did not receive contributions, loans, or expenditures in excess of fifty thousand dollars. She further states that she did not have expenditures in excess of twenty-five thousand dollars in the aggregate during the aggregating period.

A review of Ms. Holden's 30-P, 10-P, and 10-G campaign finance disclosure reports for the February 6, 2010 election indicate an aggregate total of expenditures in the amount of $26,575.41. Ms. Holden is a district level candidate who had more than $25,000 in expenditures in connection with her election, therefore, she is required to electronically file her reports.

18:1485C. Each candidate for a major or district office and each principal campaign committee of a candidate for a major or district office that receives contributions or loans in excess of twenty-five thousand dollars in the aggregate during the aggregating period or that makes expenditures in excess of twenty-five thousand dollars in the aggregate during the aggregating period shall electronically file reports of contributions and expenditures with the supervisory committee.
18:1505.4A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until the report is filed.

Recommendations:
Reduce late fee to $420 since paper report was originally filed 7 days late.
