Attorney Leo Hamilton states that E. Edwards Barham is a member of the Louisiana Technical College System Board. He also owns Gently Choices Birth Center (Birth Center). Dr. Patricia Burch-Nevils uses space at the Birth Center, at no charge, to see a few old patients on a one-day per week basis. The space is provided purely as a gratuity. There is no business or financial relationship between Dr. Burch-Nevils, and the Birth Center or the Barhams. Dr. Burch-Nevils has applied for a position at the South Louisiana Community College. The South Louisiana Community College is under the supervision of the Louisiana Community College System.

Section 1112 of the Code prohibits a public servant from participating in a transaction with his governmental entity in which a person who is a party to an existing contract with the public servant has a economic interest.
Section 1111C(2)(d) of the Code prohibits a public servant from accepting anything of economic value for services rendered from a person who has a business or financial relationship with the agency of the public servant.
