Advisory opinion regarding the application of the post-employment restrictions to Shelton Evans, a former employee of the Department of Health and Hospitals.
Facts:
Shelton Evans worked as a Program Manager 2 with the Medicaid Management and Information Systems Section of the Department of Health and Hospitals. He terminated his employment on October 29, 2010. Mr. Evans managed subordinate staff in the Medicaid Administrative Reporting Subsystem in querying, analyzing and providing Medicaid claims data reports to internal DHH departments and outside entities. He was also responsible for reviewing and approving level 1 MMIS system change requests as well as serving as the lead project manager for Medicaid Information Technology Architecture (MITA) initiative.

Mr. Evans is seeking employment with Louisiana Healthcare Connections, Inc. in its provider relations/contracting departments. Louisiana Healthcare Connections is a contractor of the Department of Health and Hospitals. Mr. Evans is seeking the following potential positions: contract negotiator, provider relations manager, or contract implementation manager.

Law:
La. R.S. 42:1121B prohibits a public servant, for a period of two years following the termination of his public employment, from rendering any service which such former public employee rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
La. R.S. 42:1121B prohibits a former public servant, for two years, from assisting another person, for compensation, in a transaction in which she participated during her public employment and which involves the governmental entity.
La. R.S. 42:1121C of the Code prohibits a legal entity in which a former public servant becomes an "officer, director, trustee, partner, or employee," for two years, from assisting a person for compensation in a transaction in which the former public servant participated.

Recommendations:
Adopt proposed advisory opinion.
