Advisory opinion regarding whether a company owned by an employee of the New Orleans Office of Community Development may contract with the New Orleans Hornets and the New Orleans Recreation Department.
Facts:
Ryan Duplessis is an employee of the New Orleans Office of Community Development as an Urban Rehab Specialist. Mr. Duplessis owns Duplessis Group. Duplessis Group is seeking to enter into a cooperative endeavor agreement with the New Orleans Hornets and the New Orleans Recreation Department. Duplessis Group would perform refurbishment of the Sam Bonart Playground basketball court. The duties would include power washing the court, the under portion of the covered basketball shelter and four backboards; resurfacing the basketball court with the Hornets new court design; repainting all four backboards and the volleyball lines; adding the Hornets' logo, the sponsor's logo; and replacing the basketball rims. None of the duties performed by Duplessis Group are within the course of Mr. Duplessis' employment duties as an Urban Rehab Specialist.

Law:
La. R.S. 42:1111C(1)(a) prohibits a public servant from receiving any thing of economic value for any service, the subject matter of which is devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and in which the public servant has participated.

La. R.S. 42:1113A prohibits a public servant, a member of his immediate family or a legal entity in which either owns a controlling interest, from bidding on or entering into a contract, subcontract or transaction that is under the supervision or jurisdiction of the public servant's agency.

Recommendations:
Adopt proposed advisory opinion.
