Advisory opinion regarding the applicability of the post employment restrictions to Mattie Ann Fincher Coxe, the former Environmental Impact Manager, for the Louisiana Housing Finance Agency.
Facts:
Mattie Ann Fincher Coxe was employed with the Louisiana Housing Finance Agency (LHFA) as an Environmental Impact Manager. As such, she personally verified or prepared environmental reviews or supervised other staff in verifying or preparing environmental reviews for certain projects funded with regular Home Investment Partnership Program funds. Ms. Coxe terminated her position with LHFA on July 13, 2011. During the Regular 2011 Legislative Session, the legislature passed legislation that would create the Louisiana Housing Corporation on December 31, 2011 and thereby abolishing the LHFA as of July 30, 2012. Ms. Coxe would like to become an environmental consultant and determine the limits concerning the post employment restrictions.

Comments:
This matter came before the Board at its September meeting. The Board deferred the matter to obtain additional information.

Law:
La. R.S. 42:1121B prohibits a public servant, for a period of two years following the termination of his public employment, from rendering any service which such former public employee rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
La. R.S. 42:1121B prohibits a former public servant, for two years, from assisting another person, for compensation, in a transaction in which she participated during her public employment and which involves the governmental entity.

Recommendations:
Adopt proposed advisory opinions.
