Appearance in connection with a second request for reconsideration of a waiver request of Kenneth Thompson regarding a $550 late fee for filing his candidate personal financial disclosure statement 11 days late
Facts:
Kenneth Thompson filed his Tier 3 candidate personal financial disclosure statement 11 days late. He received a notice of delinquency on October 4, 2010 and filed on November 2, 2010. Mr. Thompson was not aware of the requirement. Further, Mr. Thompson is retired and on a fixed income. He volunteers his time at the Fire Department putting in many hours keeping the trucks in running order. The pay for the position of Alderman is only $52.01 per month. The fine will cause a financial hardship.

Comments:
The $550 fine was reduce to $300 based on future compliance with the Code.

Law:
LSA R.S. 18:1495.7 requires candidates to file a personal financial disclosure statement with the Board of Ethics within 10 days of qualifying to run for office.
Section 1124.3 of the Code requires persons holding a public office who represent a voting district having a population of less than 5,000 to file a financial disclosure statement.
Section 1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by send him a notice of delinquency by certified mail. The notice of delinquency shall give the filer fourteen (14) business days after receipt to correct delinquent report or provide an answer contesting the delinquency.


Recommendations:
Decline to reconsider.
