Request that the Board waive the $420 late fee assessed against Paul Naquin, Jr., a candidate for St. Mary Parish President in the October 22, 2011 election, whose 30-P campaign finance disclosure report was filed 9 days late.
Facts:
In connection with her request for a waiver of the $360 late fee assessed for the late filing of a 30-P campaign finance report, Jysele C. Jones, on behalf of Paul Naquin, Jr., states that the candidate's wife timely filed a report on paper form; however, Mr. Naquin's wife was unaware of her husband's requirement to electronically file the report. Ms. Jones maintains that upon receipt of notice from the Campaign Finance division, the report was immediately filed. Mr. Naquin is district level candidate. This is his seventh election. He was an unsuccessful candidate.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S. 42:11457 for each day until such report is filed.

Recommendations:
Reduce to $100, since this is first time electronically filing; and it was filed within 10 days of the due date.
