Request that the Board waive the $600 late fee assessed against Mark D. Chiasson, a candidate for Thibodaux City Court Judge, in the October 4, 2008 election, whose Supplemental campaign finance disclosure report was filed 174 days late. |

In connection with his request for a waiver of the $600 late fee assessed for the late filing of a Supplemental campaign finance report, Mark D. Chiasson states that he closed his post office box in December of 2010, and therefore he did not receive correspondence dated January 12, 2011, sent to his post office box by the Campaign Finance division notifying him of his requirement to file the report. He further states that a second letter (certificate of vote) dated April 19, 2011 was also sent to his post office, however he did not receive it due to the fact that his post office box was closed. He maintains that he received correspondence by regular mail sent to his physical address dated August 4, 2011, at that time he contacted and spoke with staff regarding its contents. A Supplemental report was immediately filed once he was notified of his requirement to file the report. Mr. Chiasson is a district level candidate. This is his first election. He was a successful candidate.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S. 42:11457 for each day until such report is filed.
