Advisory opinion regarding whether Beau James Brock may provide legal counsel to Liberty Water Company within two years of the termination of his service with the LA Department of Environmental Quality. |

Beau James Brock served as the Confidential Assistant to the Secretary of the Department of Environmental Quality (DEQ) from January 2008 until August 2010. From August 2010 until January 2011, Mr. Brock served as the Assistant Secretary for the Office of Compliance within DEQ.
Mr. Brock has been retained to represent Liberty Water Company in matters involving DHH and the Public Service Commission, but not involving anything with the Department of Environmental Quality. Further, Mr. Brock is not providing any assistance to those attorneys retained to assist Liberty Water Company in matter before the Department of Environmental Quality. In addition, Liberty Water Company had not conducted any business in Louisiana while Mr. Brock was employed at the Department of Environmental Quality.

Section 1121B of the Code prohibits a public servant, for a period of two years following the termination of his public employment, from rendering any service which such former public employee rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed. Section 1121B of the Code prohibits a former public servant, for two years, from assisting another person, for compensation, in a transaction in which she participated during her public employment and which involves the governmental entity.
Section 1121A(1) of the Code prohibits a former agency head, for a period of two years following the termination of his public service, from assisting another person for compensation in a transaction, or in an appearance in connection with a transaction, involving his former agency.
