Advisory opinion regarding the potential employment opportunities of Cindy Greenstein, wife of Bruce Greenstein, Secretary of the Department of Health and Hospitals (DHH). |

Bruce Greenstein is the Secretary of DHH. His wife, Cindy Greenstein, would like to utilize her degree in Public Health to improve the quality outcome within health care entities for the citizens of Louisiana. Mrs. Greenstein in considering two employment possibilities:
(1) Louisiana Health Service and Indemnity Company, d/b/a Blue Cross/Blue Shield of Louisiana is a health insurer, licensed and regulated by the Louisiana Department of Insurance. Blue Cross/Blue Shield is not a health care provider licensed or certified by DHH, nor is it a Medicaid-enrolled provider. Further, Blue Cross/Blue Shield has no contracts with DHH. Blue Cross/Blue Shield has quality improvement programs in the allied health field. Mrs. Greenstein would like to accept employment with Blue Cross/ Blue Shield.
(2) Pennington Biomedical Research Center is a medical research complex that is part of Louisiana State University. Pennington receives funding via an annual appropriation from the State of Louisiana through grants and contracts from the National Institute of health, U.S. Department of Agriculture, the U.S. Department of Defense, the Pennington Medical Foundation, and the Pennington Biomedical Research Foundation. Pennington is not a health care provider licensed or certified by DHH, nor is it a Medicaid -enrolled provider. Further, Pennington has no contracts with DHH. Possible employment projects include research into quality initiative projects to improve quality measures.

La. R.S. 42:1119A states that no member of the immediate family of an agency head shall be employed in his agency.
La. R.S. 42:1111C(2)(d) prohibits a public servant and a legal entity in which the public servant exercises control or owns an interest from receiving any thing of economic value for services rendered to or for any person during his public service unless such services are neither performed for nor compensated by any person that has or is seeking to have a contractual, business or financial relationship with the public servant's agency, that conducts operations or activities that are regulated by the public employees' agency, or that has a substantial economic interest which may be substantially affected by the performance or nonperformance of the public employee's official duty.
