Advisory opinion request regarding whether Jamie Tairov, an employee of the LSU AgCenter, may serve as a contractor for the Louisiana FFA Foundation.
Facts:
Jamie Tairov was hired by the LSU AgCenter in 2006 as an Administrative Coordinator 3 to work with the Louisiana FFA Association. The FFA Association is housed in the AgCenter with all salaries, office costs, and travel funded by the AgCenter budget. The Louisiana FFA Association funds all of its activities, including state officer activities, annual conventions, and numerous small events throughout the year, with a private account that obtains its funding from student and chapter dues, fees collected at events and sponsorships from the national organization. The Association's activities and awards are also funded by sponsorships gathered by the Louisiana FFA Foundation, a non-profit 501c(3) organization. The Foundation consists of a Board of Directors that oversees the funding sources. The Foundation does not receive any state or AgCenter funding.

Mr. Tairov would like to contract with the FFA Foundation to serve as an independent contractor. The services he would provide under this contract include sending sponsorship requests to past sponsors, managing Foundation accounts, filing taxes, taking board meeting minutes and scheduling. He would receive $800 per month for the length of the contract. The contract would not be contingent on his continued employment with the AgCenter or the FFA Association.

Law:
R.S. 42:1111C(2)(d) prohibits a public servant from accepting any thing of economic value for or in consideration of services rendered from a person who has or is seeking to have a contractual, business, or financial relationship with the public servant's agency;
Recommendations:
Adopt proposed advisory opinion.
