An advisory opinion regarding whether the Morehouse Parish School Board may employ the wife of school board member, Mike Stephens. |

The Morehouse Parish School Board employs on an as needed basis certified teachers to administer to each student individually in grades K through 3 the State Department of Education DIBELS reading assessment. The retired teacher in question would be employed on a part-time as needed basis, together with a number of other retired teachers to test each student individually in the student's knowledge of reading, phonics, word fluency, letter and word recognition and like reading skills.

Section 1119B(1) prohibits an immediate family member of a governing authority from being employed by the governmental entity.
Section 1119B(2)(a)(I) provides an exception which allows for the immediate family member of a school board member to be employed by the school district if she is certified to teach and is a classroom teacher.
