RE:
Advisory opinion request regarding whether the Cameron Parish Assessor or an employee of the Cameron Parish Assessor's Office serving on a local board of the Cameron Parish taxing bodies.
Facts:
The population of Cameron Parish has dropped by approximately 33% due to devastation caused by two hurricanes in the recent past. As a result it has been difficult to find persons to serve on the local board of the Cameron Parish taxing bodies (e.g. Recreation District, Drainage District, Water District, Hospital District).
Ms. Kelley stated that her office does not have jurisdiction over the boards in question, and that the boards in question do not have jurisdiction/supervision over her office. The only connection between the Assessor's Office and all the entities is that the Assessor's Office acts as the go between for collecting millage resolutions and forwarding them to the Legislative Auditor. Each Board approves their own millage rates according to the tax dollars they need to collect and what is voted on by their district. The Assessor's office has no supervision or jurisdiction over such matters. Further, the Assessor's Office does not have anything to do with the appointments to the local taxing bodies. The appointments are the responsibility of the Police Jury.

Law:
Section 1113 of the Code prohibits a public servant from bidding on or entering into a contract or transaction that is under the supervision of the public servant's agency.





Recommendations:
Adopt proposed advisory opinion.
