Advisory opinion regarding the definition of "political committee" in the Campaign Finance Disclosure Act and whether political committees as defined by the CFDA are permitted to make contributions to organizations that make independent expenditures.
Facts:
J. Keith Gates, an attorney for the Freedom Through Justice Foundation has requested an advisory opinion regarding the applicability of the CFDA following the decision in Citizens United v. Federal Election Commission. He specifically wanted the Board of Ethics to answer questions regarding the definition of political committee and whether the applicable contribution limits apply to individuals or political committees who make contributions to organizations that make independent contributions.
Law:
Rule 601A of the Rules for the Board of Ethics requires that the party requesting an advisory opinion be an "affected party" having an interest in the rendering of the opinion.
Recommendations:
Decline to render an advisory opinion.
