Request that the Board waive the $540 campaign finance late fee assessed against James F. "Jim" Slagle, a candidate for Senate, District 39 in the October 22, 2011 election, whose 30-P campaign finance disclosure report was filed 9 days late.
Facts:
In connection with his request for a waiver of the $540 late fee assessed for the late filing of a 30-P campaign finance disclosure report, James "Jim" Slagle states that he misread the instructions regarding the filing requirements for candidates. He further states that since he has in the past filed as an "any other" level candidate, he assumed that he was required to file only if he had expenditures over $5,000 or received contributions over $200 from any one source. He maintains that he did not receive any contributions or had expenditures over $5,000; and the total amount taken in expenditures was the amount of his filing fee, which was $600. Mr. Slagle is a district level candidate. This is his fifth election. He was an unsuccessful candidate.

Mr. Slagle was a "district" office level candidate for a Senate seat in the October 2003 election, for which he electronically filed campaign finance reports.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
