RE:
Request that the Board waive the $420 campaign finance late fee assessed against Brenda Shelling, a candidate for State Representative, District 17, in the October 22, 2011 election, whose 30-P campaign finance disclosure report was filed 7 days late.
Facts:
In connection with her request for a waiver of the $420 late fee assessed for the late filing of a 30-P campaign finance disclosure report, Brenda Shelling states that in haste of submitting the report, she inadvertently left it out and mailed her personal finance disclosure report instead. She maintains that she immediately mailed her 30-P report on September 24, 2011 once she realized her omission.

A review of the envelope in which the 30-P report was mailed indicates that it was not post marked by the post office, and therefore the Campaign Finance disclosure staff gave credit for receipt of the report one day prior to the date it was actually received in the office. Ms. Shelling is a district level candidate. This is her seventh election. She was an unsuccessful candidate.

A 10-P campaign finance disclosure report filed 146 days late, in connection with the October 5, 2002 election, a Special report filed 1 day late, in connection with the October 2, 2010 election, and an EDE-P campaign finance disclosure report filed 1 day late in connection with the October 2, 2010 election. The late fees assessed for the late filings of the report have been paid.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.

Recommendations:
