Advisory opinion regarding whether the Assumption Parish Police Jury can purchase a vehicle from Barbera Chevrolet when the spouse of Myron Matherne (a police juror with the Assumption Parish Police Jury) is a commissioned salesperson employed with the dealership.
Facts:
The Assumption Parish Police Jury is interested in purchasing a vehicle from Barbera Chevrolet. The spouse of Myron Matherne (a police juror with the Assumption Parish Police Jury) is a commissioned salesperson employed with the dealership. The structure of the Assumption Parish Police Jury is similar to that of other police jury governments throughout the State of Louisiana in that the jurors are elected and not considered full-time employees.
Law:
Section 1111C(2)(d) of the Code would prohibit the spouse of a public servant from receiving anything of economic value for or in consideration of services which are performed for or compensated by a person from whom the public servant is prohibited from receiving a gift by Section 1115A(1) or (B). This includes someone who has or is seeking a business, financial, or contractual relationship with the public servant's agency.

Recommendations:
Adopt proposed advisory opinion.
