RE:
Advisory opinion regarding whether the Lower Mississippi River Port-wide Strategic Security Council may hire an Executive Director who is an Legislator or other part-time elected official.
Facts:
The five ports along the Mississippi River between Baton Rouge and New Orleans have formed an association known as the Lower Mississippi River Port-wide Strategic Security Council. The purpose of the association is to better understand the needs of the ports as well as to work with federal authorities for the purpose of handling federal security grants effecting the lower Mississippi River and the infrastructure associated and along the river corridor. The Council would like to hire an Executive Director on a part-time, consulting contract basis and expressed concern as to whether this person can be a Legislator or other part-time elected official.

Law:
Section 1113C of the Code states that no legislator shall enter into or be in any way interested in any contract, subcontract or other transaction involving the legislator's agency.

Recommendations:
Adopt proposed advisory opinion.
