Advisory opinion concerning whether the father-in-law of Pointe Coupee Parish School Board employee, Cherie Cazayoux, may continue to provide insurance to the school board. |

Mr. Donald J. Cazayoux is the President/Owner of Cazayoux Insurance Agency located in New Roads. Mr. Cazayoux has been providing insurance coverage to the Pointe Coupee Parish School Board on and off since 1981. His daughter-in-law, Cherie Cazayoux, was hired as a certified special education teacher in August 1982, and has been working as an Individual Evaluation Plan (IEP) Facilitator in the Central Office of the School Board since November 1, 2001.

Section 1113A(1)(a)of the Code prohibits public servants, their immediate family members, or legal entities in which they have a controlling interest, from bidding on or entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant. According to 1102(2)(a), "agency" means a department, office, division, agency, commission, board, committee, or other organizational unit of a governmental entity.
Section 1112 prohibits a public servant from participating in a transaction involving her governmental entity in which she, or any member of her immediate family, has a substantial economic interest.
