Request that the Board waive the $480 late fee assessed against Steve Guidry, a candidate for Sheriff of St. John the Baptist Parish in the October 22, 2011 election, whose 10-P campaign finance disclosure report was filed 8 days late.
Facts:
In connection with his request for a waiver of the $480 late fee assessed for the late filing of a 10-P campaign finance disclosure report, Michael D. Breaux, counsel for Steve Guidry states that Mr. Guidry withdrew as a candidate on September 12, 2011, five (5) days after he became a candidate. Mr. Breaux maintains that Mr. Guidry believed that since he withdrew before the 10-P campaign finance disclosure report was due, he was not required to file the report. He maintains that upon receipt of notice from the Campaign Finance division, the report was immediately filed. Mr. Guidry is a district level candidate. This is his second campaign.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.

18:1495.4B(7) provides that "The final report of a candidate who either withdraws as a candidate or is unopposed for election to the office he seeks shall be the next report due as required in this Subsection as of the date that the candidate withdraws or ascertains that he is unopposed, unless supplemental reports are required as provided in Subsection D of this Section. The report shall contain a statement that it is the final report and the reasons therefor."

Decline to waive late fee.
