Advisory opinion regarding whether Quadel Consulting Corp may submit a proposal to the Louisiana Housing Authority (LHA) to serve as the Subsidy Administrator for the LHA Project-Based Voucher Program.
Facts:
Quadel Consulting Corporation ( "Quadel ")is a national expert in public housing, housing choice voucher, HUD - subsidized multifamily, and tax credit programs. Karyl Dunson, Manager of Human Resources and Administration for Quadel Consulting Corporation states that under the proposed contract with LHA Quadel will serve as Subsidy Administrator to administer the Project -Based Voucher (PBV) program, which provides the rent subsidy for the Permanent supportive Housing (PSH) participants. Quadel has not been privy to any confidential information that would provide it with an unfair competitive advantage. As such, Quadel does not have an "unequal access to information" organizational conflict of interest. Quadel has not contributed to the statement of work or the specifications outlined in RFP. Quadel would not be evaluating its affiliates', or a competitor's performance or proposals under this contract. Neither Quadel nor any of its employees have ever engaged in any actions, or even been accused of engaging in any actions, that could violate the Louisiana Code of Governmental Ethics.

Quadel is currently a prime contractor and serves as the Subsidy Administrator for the LA OCD Permanent Supportive Housing Program. As the Prime Contractor, Quadel provides administrative services to assist OCD in determining eligibility for the issuance of Project -Based Section 8 housing vouchers, issuing rental payments to landlords, and inspecting properties to ensure they are maintained in accordance with HUD and OCD program requirements. Quadel is also currently a subcontractor on the LA OCD Small Rental Program supporting ACS. Quadel provides ACS and OCD with assistance with Small Rental policy development, updating and maintaining program documents, preparing correspondence, and assisting in reviewing Uniform Relocation Act implementation procedures.

Law:
Section 1112 of the Code prohibits a public servant from participating in a transaction in which he has a substantial economic interest. Section 1102(21) of the Code defines "substantial economic interest" as an economic interest which is of greater benefit to the public servant or other person than to a general class or group of persons.
Recommendations:
Adopt the proposed advisory opinion.
