Request that the Board waive the $60, campaign finance late fee assessed against Beatrice "Doctor Bea" Desper, a candidate for Coroner for St. Tammany Parish, in the October 22, 2011 election, whose 10-P campaign finance disclosure report was filed 1 day late.
Facts:


In connection with her request for a waiver of the $60 late fee assessed for the late filing of a 10-P campaign finance report, Beatrice "Doctor Bea" Desper, states that she is sure she faxed her report on the date it was due, however, she received notice that her report was late. Ms. Desper is a district level candidate. This is her first campaign. She was an unsuccessful candidate.
A review of Ms. Desper's 10-P report shows that it was mailed and has a USPS date of October 13, 2012. The campaign finance division does not have a faxed copy of a 10-P report. However, the campaign finance division is in receipt of a 10-G campaign finance disclosure report that was faxed and mailed.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
