In connection with his request for a waiver of the $600 late fee assessed for the late filing of a Special campaign finance report, Daniel Jude Babin states that he mistakenly failed to report a contribution. When he first received the contribution it was in excess of his contribution limit. He had the individual to issue a new donation, however, he did not pay attention to the date on the new check whenever he received it. He further states that at the time the Candidate's Report was due, after looking at the date the check was received, he realized that he did not file the proper report in time. He maintains that he contacted the Campaign Finance division and was told to file a Candidate's Special Report for the contribution he received. Mr. Babin is an any other level candidate. This is his first campaign. He was a successful candidate.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
