Request that the Board waive the $360 campaign finance late fee assessed against Sherman Mack, a candidate for State Representative, District 95, in the October 22, 2011 election, whose EDE-P campaign finance disclosure report was filed 6 days late.
Facts:
In connection with his request for a waiver of the $360 late fee assessed for the late filing of an EDE-P campaign finance report, Sherman Mack, states that his report was filed untimely because he did not have any expenditures and he relied on page 4, item F, of the summary of the Louisiana Campaign Finance Disclosure Act. He further states that he did not read in the instructions that an EDE-P report was mandatory. However, his review of the actual report form revealed that a report was mandatory. Mr. Mack is a district level candidate. This is his second campaign. He was a successful candidate.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
