Request that the Board waive the $400 and $200 campaign finance late fees assessed against Tiffany Poche, a candidate for Ascension Parish Council, District 5, in the October 22, 2011 election, whose EDE-P and 10-P campaign finance disclosure reports were filed 14 and 5 days late.
Facts:
In connection with her request for a waiver of the $400 and $200 late fees assessed for the late filings of an EDE-P and 10-P campaign finance reports, Felicia M. Wilson, on behalf of Tiffany Poche, states that she is the mother of the candidate and assisted her daughter with filing campaign finance reports. Since the candidate had no expenditures, she did not realize that the EDE-P report was required for filing. She further states that she filed the 10-P report while using a Macintosh computer and thought the report had been filed, however, after several days she realized that the report had not been filed. She contacted the IT department and was able to work through issues between her MAC software and the LEADERS software system and file the report electronically. Ms. Poche is an any other level candidate. This is her first campaign. She was an unsuccessful candidate.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.



Recommendations:
Suspend all but $100 based on future compliance for the late filing of the EDE-P report. Decline to waive for the late filing of the 10-P report.
