Request that the Board waive the $300 and $700 campaign finance late fees assessed against Jamie Labranche, a candidate for Commissioner of Agriculture and Forestry, in the October 22, 2011 election, whose EDE-P and 10-G campaign finance disclosure reports were filed 3 and 7 days late.
Facts:
In connection with his request for a waiver of the $300 and $700 late fees assessed for the late filings of an EDE-P and 10-G campaign finance reports, Jamie Labranche states that he faxed his EDE-P report on the date that it was due and called the next day to confirm it was received. When he learned that it was not received, he sent the report again. Mr. Labranche is a major level candidate. This is his first campaign. He was an unsuccessful candidate.

Staff contacted candidate to obtain fax confirmation document, however, candidate was unavailable.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.



Recommendations:
Suspend all but $300 of the assessed fine for the EDE-P report based on future compliance. Decline to waive for the late filing of the 10-G report.
