Advisory opinion request regarding Gossen-Holloway and Associates entering into a contract with the Bayou Community Academy, Inc., when the wife of an owner serves as the school's director. |

Bayou Community Academy, Inc. (BCA) is a Type 1 Charter school in Lafourche Parish. The school is presently operating in its first year at a facility rented from the Parish. The school is outgrowing its current facilities and needs to move forward with constructing its own buildings on donated land.
Sandy Holloway is the School Director. BCA is considering using Gossen-Holloway and Associates as the architect on the project. Gossen-Holloway is the sole proprietorship of Skip Holloway, who is the spouse of Sandy Holloway.

R.S. 42:1113A states no public servant, or a member of such a public servant's immediate family, or a legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
