RE:
Request for an advisory opinion regarding whether the Town of Vivian may hire the son of Ryan Nelson, the Vivian Chief of Police.
Facts:
The Town of Vivian has a received an application for employment from the son of Ryan Nelson, the elected police chief The position applied for is in the water plant as plant operator. The water plant where he will do most of his work is located outside the corporate limits of the Town. The water plant is under the Public Works Department, which is under the supervision of the Public Works Director who is ultimately under the supervision of the Mayor/Town Council. The Chief of Police has no authority over any employee or budget other than the police department staff and budget. In all regards the police department is a separate and distinct agency from the Town.

Law:
Section 1119 of the Code of Ethics states that no member of the immediate family of an agency head may be employed by his agency.

Recommendations:
Adopt proposed advisory opinion.
