Request that the Board waive the $1,140 campaign finance late fee assessed against Barry Bernadas, a candidate for Sheriff of St. Bernard Parish, in the October 22, 2011 election, whose 30-P campaign finance disclosure report was filed 19 days late.

In connection with his request for a waiver of the $1,140 late fee assessed for the late filing of a 30-P campaign finance report, Barry Bernadas states that on September 21, 2011 he faxed his report. However, when he visited the Ethics Board office on October 12, 2011 to seek assistance with the LEADERS program, he was informed that his report was not received. The report was faxed filed later that afternoon. Mr. Bernadas further states that he received a call the next day from the Ethics' office and was questioned by an unknown female about the late filing of the report. He maintains that he was told that the matter would be checked into; however, he did not hear back from that person. Mr. Bernadas maintains that he timely filed his report and ask that the late fee be dismissed. Mr. Bernadas is a district level candidate. This is his second campaign. He was an unsuccessful candidate.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
